The protection of your personal data is a special concern for us, Johann Gourmet GmbH, Annagasse 3/8, A-1010 Vienna ("Johann", "we", "us"). 2. What is personal data?

3. What personal data do we collect from you and for what purpose?
3.1. Contact
If you contact us by email, telephone or via our contact form, your provided personal data (salutation, name, email, customer number if applicable, telephone number) and the content of your inquiry will be stored with us for six months for the purpose of processing it and in case of follow-up questions (pre-contractual measures or legitimate interests). Of course, we will not transmit your inquiry to third parties without your consent, unless it concerns follow-up questions regarding orders that involve a third party (e.g. our fulfillment service provider).
3.2. Promotional contact
With your voluntarily given consent to promotional contact by us, we will process your email address, salutation and name for the sending of direct marketing materials by email in accordance with § 107 TKG to the extent agreed upon: Johann News for ongoing receipt of our offers, special promotions and new product presentations as well as exciting topics from the world of wine and spirits; Johann Events for culinary & cultural offers from the world of wines and spirits. If you have additionally given consent to the setting of marketing and analysis cookies, your consent to receive newsletters also includes the information collected in this way about your customer behavior, which we use to personalize these promotional mailings.
You can revoke your consent to promotional contact at any time, without giving reasons for all or individual purposes and with effect for the future (e.g. via a link at the end of each newsletter or via our unsubscribe link on the website). If you forward our newsletters to third parties, you are obliged to comply with the legal provisions and to obtain the prior consent of the recipient. If a third party makes claims against us due to forwarding of a newsletter by you, you will indemnify and hold us harmless with regard to all related claims including penalties and costs of legal defense.
3.3. Prize draws
In connection with prize draws offered by us, your data will only be used to process the prize draw, unless you expressly give us your consent for other use on a case-by-case basis.
3.4. Transfer to third parties
We also transfer your personal data to the necessary extent to external vicarious agents or service providers: to IT service providers and/or providers of data hosting or data processing or similar services; to other service providers, providers of tools and software solutions that also support us in providing our services and act on our behalf (including providers of marketing tools, marketing agencies, communication service providers and call centers); to any third parties who participate in the fulfillment of our obligations towards you (such as fulfillment service providers, especially the KASTNER GROUP, parcel service providers in the delivery of your webshop order to you, payment service providers in payment processing in the webshop, banks for payment processing); to other external third parties to the necessary extent (e.g. auditors, insurance companies in case of insurance claims, legal representatives when required, debt collection companies in case of payment default or failure, etc.); to authorities and other public bodies to the legally mandatory extent (e.g. tax authorities, etc.); to service providers (e.g. KSV 1870) for credit checks when purchasing through our webshop or applying for a membership card with payment function based on our legitimate interests. Our legitimate interests exist due to the associated economic risk that you may not be able to pay the invoiced amounts in these cases. In these cases, your fundamental rights and freedoms do not outweigh these interests either.
4. Storage duration
We generally store your personal data only as long as it is necessary to fulfill our obligations towards you. However, for reasons of tax and corporate law retention obligations that apply to us, we generally store your personal data provided in connection with orders for seven years after contract fulfillment.
We store your personal data transmitted in the context of inquiries for a period of six months after answering the inquiry in order to be able to respond to any follow-up questions. If you have only registered for newsletters and to receive advertising information accordingly and are not a customer of ours, we store your personal data until you revoke consent and for a maximum of three years from your last contact.
5. Data security
